These Terms of Service ("Terms") form a binding agreement between TECHLIS S.R.L., Calea Moșilor 88, Sc. F, Ap. 82, Sector 3, Bucharest 030167, Romania ("webem.io") and you or the entity you represent ("Customer"). By creating an account or using the Services, you accept these Terms.
1. The Services
webem.io provides AI brand monitoring, GEO optimization, content strategy and AI retargeting tools, accessible via web app, dashboards and API. We may update features at any time provided we do not materially degrade the Services during a paid term.
2. Accounts and credits
- You must provide accurate registration data and keep credentials confidential.
- Credits are prepaid units consumed by queries, monitors and API calls.
- Unused credits expire 12 months after purchase unless stated otherwise.
- Promotional credits are non-refundable and cannot be exchanged for cash.
3. Fees and taxes
Fees are stated at checkout. Prices may be charged in USD, EUR, GBP or PLN. You are responsible for applicable taxes, including Romanian VAT where required. Failure to pay may result in suspension.
4. Acceptable use
Use of the Services is subject to our Acceptable Use Policy.
5. Intellectual property
webem.io retains all rights in the Services. You retain rights to data you input ("Customer Data") and grant us a limited licence to host and process it solely to deliver the Services. Outputs generated by AI models are provided "as is" and may not be unique to you.
6. Warranties and disclaimers
The Services are provided "as is" and "as available". We disclaim all warranties to the maximum extent permitted by law. AI outputs may be inaccurate; Customer is responsible for reviewing outputs before relying on them.
7. Limitation of liability
To the maximum extent permitted by law, webem.io's aggregate liability is limited to the fees paid by Customer in the 12 months preceding the claim. We are not liable for indirect, incidental, special or consequential damages.
8. Termination
Either party may terminate for material breach uncured for 30 days. We may suspend access immediately for security, legal or payment reasons.
9. Governing law
These Terms are governed by the laws of Poland. Disputes shall be resolved by the courts competent for the seat of webem.io, without prejudice to mandatory consumer rights.
